Terms and Conditions
1. Our Role
Baja Blue Experiences arranges reservations for private boat experiences, fishing trips, yacht charters and other activities provided by independent operators.
Unless expressly stated in your booking confirmation, Baja Blue Experiences does not own or operate the vessels, employ their crews or directly provide the booked activity. The operator identified in your confirmation is responsible for the vessel, crew and delivery of the experience.
2. Operator Terms and Conditions
Each experience may have its own operator terms, including passenger limits, boarding requirements, safety rules, permitted items, cancellation policies and participation restrictions.
Applicable operator terms will be provided or linked before payment. Any booking-specific terms that differ from our standard policy must be clearly disclosed and accepted before the reservation is confirmed. Undisclosed restrictions will not be applied retroactively.
These terms govern Baja Blue Experiences’ reservation services. Operator terms govern the services provided by that operator, subject to applicable law.
3. Reservations and Payments
Reservations are subject to availability and are confirmed only after the required payment and written confirmation.
Your confirmation will specify the experience, date, departure time, meeting point, passenger count, total price, deposit, remaining balance and included services.
Additional hours, transportation, gratuities and other extras are included only when expressly stated. Any additional charges require your agreement.
4. Arrival and Boarding
Guests must arrive at the meeting point by the check-in time stated in their confirmation. Departure times cannot always be extended for late arrivals.
If a guest misses departure because of late arrival or fails to attend, the reservation will be treated as a no-show under the cancellation policy below.
5. Safety and Participation
Guests must follow the captain’s and crew’s safety instructions. The captain may change the route, postpone departure or end an activity when necessary for safety.
Participation may be refused when a guest’s intoxication, dangerous behavior or failure to follow safety instructions creates a risk. Any resulting charges or refund restrictions must follow the previously disclosed operator terms and applicable law.
Minors must be accompanied by a responsible adult and meet the operator’s participation requirements. Guests with concerns about an activity’s suitability should contact us before booking.
6. Changes to the Experience
Routes and activities may depend on weather, sea conditions, port restrictions and operational requirements.
Any proposed material change to the confirmed vessel, departure time or experience will be communicated to the guest. A substitute vessel will not be imposed without the guest’s agreement.
7. Personal Belongings and External Services
Guests should take appropriate care of personal belongings and protect electronic devices from water.
Transportation and other optional services may be provided by separate companies. The provider and applicable terms will be disclosed when those services are arranged.
8. Responsibility and Consumer Rights
The independent operator is responsible for performing its services and meeting applicable operational and safety requirements. Baja Blue Experiences remains responsible for its own reservation services and obligations under applicable law.
Nothing in these terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
Cancelaciones y Reembolsos
1. Cancellations at Least 48 Hours Before Departure
Under Baja Blue Experiences’ standard policy, cancellations received at least 48 hours before the scheduled departure time qualify for a refund of the reservation deposit, without a Baja Blue Experiences cancellation penalty.
Any different operator policy must be clearly disclosed and accepted before payment.
2. Cancellations Less Than 48 Hours Before Departure
For guest-initiated cancellations received less than 48 hours before the scheduled departure time, the reservation deposit is forfeited and is non-refundable, subject to applicable law.
This also applies to no-shows and missed departures caused by late arrival.
This clause concerns the deposit. Any treatment of amounts paid beyond the deposit must be disclosed in the applicable booking terms.
3. How to Cancel
Cancellation requests must be sent in writing through the Baja Blue Experiences email or WhatsApp contact provided in your booking confirmation.
The notice period is calculated from the time the request is received, using the local time in Cabo San Lucas. A delayed response from our team does not change the time your request was received.
4. Rescheduling
Rescheduling is subject to operator availability and applicable booking terms. Please request changes at least 48 hours before departure.
A rescheduling request does not automatically cancel the original reservation or waive a late-cancellation penalty.
5. Operator Cancellations and Unsafe Conditions
The deposit-forfeiture rule does not apply when Baja Blue Experiences or the operator cancels the experience.
If the experience cannot take place because of unsafe conditions, a port closure or an operator cancellation, we will assist with rescheduling or the applicable refund. A credit or alternative date will not replace a refund to which the guest is legally entitled without the guest’s agreement.
6. Refund Processing
Refunds handled by Baja Blue Experiences will be returned through the original payment method whenever possible. Processing times may depend on the bank or payment provider.
For payments made directly to an operator, that operator processes the refund. Baja Blue Experiences will assist with the request.
7. Acceptance
Before payment, guests must have access to these terms and any applicable operator terms. By confirming the booking, guests acknowledge and accept the terms presented for their reservation, without waiving mandatory consumer rights.
