Cancellation and Refund Policy
This policy explains cancellations and refunds for reservations arranged through Baja Blue Experiences. The deposit paid to Baja Blue Experiences and payments made to the independent experience operator are subject to separate policies, as explained below.
1. Baja Blue Experiences Reservation Deposit
Baja Blue Experiences arranges reservations with independent boat owners, charter companies, fishing operators and other activity providers. Unless expressly stated in your confirmation, we do not own or operate the vessel or directly provide the booked activity.
The reservation deposit collected by Baja Blue Experiences represents our commission for arranging the booking. Refunds of this deposit are governed by the cancellation rules below.
Before payment, your booking details will identify the total price, the deposit payable to Baja Blue Experiences, the amount payable to the operator and whether the deposit is included in the quoted total.
2. Cancellations at Least 48 Hours Before Departure
Guest cancellations received at least 48 hours before the scheduled departure time qualify for a full refund of the reservation deposit paid to Baja Blue Experiences, without a Baja Blue Experiences cancellation fee.
This includes cancellations received exactly 48 hours before departure. Refunds of separate payments to the operator are governed by that operator’s disclosed policy.
3. Cancellations Less Than 48 Hours Before Departure
For guest cancellations received less than 48 hours before the scheduled departure time, the reservation deposit paid to Baja Blue Experiences is forfeited and is non-refundable, subject to applicable law.
This rule also applies to no-shows and missed departures caused by late arrival. It concerns the Baja Blue Experiences deposit only; it does not automatically determine the treatment of other payments.
4. Independent Operator Cancellation Policies
Each vessel or experience operator may have its own cancellation deadlines, refund conditions and rescheduling rules. Those terms must be provided or linked before payment and clearly identified in your booking details.
Operator terms apply to amounts paid to that operator or expressly collected on its behalf. They do not replace Baja Blue Experiences’ 48-hour policy for its own commission deposit.
A guest may therefore qualify for a refund of the Baja Blue Experiences deposit while a separate operator payment remains non-refundable under previously disclosed terms. We will assist with operator refund requests, but cannot promise refunds beyond the operator’s obligations and applicable law.
5. How to Cancel
Send your cancellation request in writing to bajablueexperiences@gmail.com or to the Baja Blue Experiences WhatsApp number shown in your booking confirmation. Include the booking name or reference, experience date and a clear request to cancel.
The 48-hour period is measured from when your request reaches our designated email or WhatsApp channel, using the local time in Cabo San Lucas, Mexico, and the confirmed departure time. A delayed response from our team does not change when the request was received.
Keep a copy of your request and its timestamp. If your booking also requires direct notice to the operator, follow the procedure disclosed in its terms.
6. Rescheduling
Date, time and vessel changes are subject to availability and the operator’s terms. Please request changes at least 48 hours before departure.
A rescheduling request does not automatically change or cancel the original booking. Any approved change, deposit transfer or additional charge will be confirmed in writing. A request made less than 48 hours before departure does not automatically waive the deposit-forfeiture rule.
7. Cancellations by Baja Blue Experiences or the Operator
The guest late-cancellation penalty does not apply if Baja Blue Experiences or the operator cancels the booked experience, including when it cannot proceed because of unsafe conditions or a port closure.
If the experience cannot take place, the reservation deposit paid to Baja Blue Experiences will be refunded in full unless you choose an agreed alternative date or experience. Separate operator payments will be handled under the operator’s disclosed terms and applicable law.
A credit or substitute experience will not replace a refund to which you are legally entitled without your agreement. If the operator remains able to provide the confirmed service and you choose not to attend, the guest-cancellation rules apply, subject to applicable law.
8. Refund Processing and Acceptance
Approved refunds of Baja Blue Experiences deposits will be issued through the original payment method whenever possible. We will confirm processing details; the time for funds to appear may depend on the bank or payment provider.
Payments made directly to an operator are refunded by that operator. Baja Blue Experiences will assist with the request and remains responsible for its own services and for any funds it collects.
This policy and the applicable operator terms must be available before payment. By confirming a reservation, you acknowledge the terms presented for that booking. Nothing in this policy limits mandatory consumer rights or refunds required by applicable law.
